Terms of service — WorkSmart4Life

These terms govern your use of the WorkSmart4Life website, products, courses and tools (the “Service”). By placing an order or creating an account, you agree to them. WorkSmart4Life is part of a family of wellbeing brands created by Dr Alten du Plessis (alongside FlourishIQ, FlourishTalk and InspireWell4Life), and is powered by FlourishIQ. FlourishTalk is the seller and processes card payments, so FlourishTalk is the name on your statement. Please also read our privacy policy and refund policy, which form part of these terms.

1. Your account and orders

Give accurate details and keep any login secure. You are responsible for activity under your account.
Accounts and personalised products are personal to you. Do not share your login, downloads or access with people who have not paid.
You must be old enough to enter a binding agreement in your country, or have the consent of a parent or guardian.

2. What we offer

The Wisdom of Work explorer and the WorkSmart Challenge are free to use, without an account.
Decks and editions are once-off purchases, delivered as personalised PDFs by email. Download links are valid for 30 days.
Company Editions carry an organisation’s branding and are made for the list of people it sends us.
Courses are annual access per course, sold and delivered on FlourishIQ.
Role tracks bundle three courses and an edition; each part follows the terms for its kind.
The Organisation Plan gives each person on an organisation’s list 12 months in every WorkSmart course, one seat per person, with The Edge; the organisation sees group figures only.
The Organisation Plan, moment packs and the Team Pack are ordered by organisations under the organisation agreement.
The Edge: points, levels, streaks and level rewards are a free part of your WorkSmart courses. The points table and the level thresholds may change; the current ones are always shown in The Edge. Rewards are one per person per level, delivered by email.
We may add, update, retire or re-organise products and tools over time.

3. Prices and payment

Prices are shown on the relevant page; the price you pay is the one shown at checkout. We may change prices from time to time.
Card payments go through PayFast and are processed by FlourishTalk, the name on your statement. Prices are in South African rand.
Team orders, Company Editions and packs can also be paid by EFT against an invoice.
Refunds follow our refund policy.

4. Licence and fair use

When you buy a product or take a course, we give you a personal, non-transferable, non-exclusive licence to use it for your own learning and work. You may not:

copy, resell, sub-license, publish or redistribute the content;
share your account, downloads or access with people who have not paid;
use the Service unlawfully, or try to disrupt it or gain access you are not entitled to.

5. Intellectual property

The content, tools, the selection and arrangement of the quotation library, the artwork, designs and branding are owned by WorkSmart4Life and its creator, Dr Alten du Plessis (and, where applicable, Stellenbosch University), and are protected by law. Each quotation remains the words of the person quoted, with its source shown. A Company Edition’s own logos and images remain the property of the organisation that supplied them. These terms do not transfer ownership to you.

6. Your content

What you write in the tools remains yours. You give us the limited permission needed to store it, show it back to you and run the Service. We treat it as private and handle it under our privacy policy.

7. Education, not medical or clinical advice

WorkSmart4Life provides educational, evidence-informed content on performance and wellbeing at work. It is not therapy, counselling or medical advice, and it is not a substitute for professional care. If you are struggling, in distress or have a health concern, please consult a qualified professional or your local emergency services.

8. Organisations

The Organisation Plan, moment packs and the Team Pack are ordered under the organisation agreement, which sets out what an organisation sees (group figures only, nothing for groups under 8) and what it never sees.

9. Affiliates

If you take part in our affiliate programme, the affiliate terms also apply.

10. Disclaimers and limits of liability

We work hard to provide a reliable, high-quality Service, but we provide it “as is” and cannot guarantee particular outcomes or uninterrupted availability. To the extent the law allows, our liability arising from your use of the Service is limited to the amount you paid us for the product or course concerned in the 12 months before the claim.

11. Suspension and ending

You may stop using the Service at any time. We may suspend or close an account that breaches these terms or is used unlawfully. Where you have paid for access and have not breached these terms, we will honour the access you paid for.

12. Governing law

These terms are governed by the laws of the Republic of South Africa.

13. Changes

We may update these terms from time to time. The date at the top shows the current version; continuing to use the Service means you accept the current terms.
